These Terms of Service (“Terms”) govern your use of the Starlings website at starlings.au and the services provided by Starlings (“Starlings”, “we”, “us”, “our”).

Our services

Starlings provides structured physical activity and movement programs delivered in person at early childhood education and care centres (“Centres”). Program details, session formats, and pricing are advised upon enquiry.


Using our website

You may use starlings.au for lawful purposes only. You must not:

  • Use the site in any way that breaches applicable laws or regulations
  • Attempt to gain unauthorised access to our systems or data
  • Transmit harmful, offensive, or misleading content via our contact form

We may suspend or restrict access to the website at any time without notice.


Bookings

Confirming a booking

A program booking is confirmed when both parties have agreed in writing, including by email. Availability is not guaranteed until confirmation is received from Starlings.

Cancellations by the Centre

If you need to cancel or reschedule a session, please notify us as early as possible. Specific cancellation terms, including any notice periods that apply, will be set out in your service agreement.

Cancellations by Starlings

We may need to cancel or reschedule a session due to coach illness, safety concerns, or circumstances outside our control. We will notify you as soon as practicable and arrange an alternative date where possible.


Centre responsibilities

When Starlings delivers programs at your Centre, you are responsible for:

  • Providing a safe environment for our coaches and for the children in your care
  • Maintaining required educator-to-child ratios during all sessions
  • Informing Starlings before each session of any medical, behavioural, or safety information relevant to participating children
  • Complying with all applicable laws and regulations governing your Centre, including the Education and Care Services National Law and National Regulations

Intellectual property

All content on our website (including text, images, logos, and program materials) is owned by or licensed to Starlings. You may not reproduce, distribute, or adapt our content without prior written permission.


Limitation of liability

To the maximum extent permitted by law, our liability to you for any loss or damage arising from use of our website or services is limited to re-supplying the relevant service.

Our services come with guarantees under the Australian Consumer Law that cannot be excluded, restricted, or modified. Nothing in these Terms is intended to exclude or limit those guarantees.

We are not liable for loss or damage that is not reasonably foreseeable, or that arises from your failure to comply with these Terms.

Our website may link to external websites. We are not responsible for the content, accuracy, or privacy practices of those sites.


Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.
